These Terms of Service (“Terms”) establish the legally binding rules, obligations, disclaimers, and limitations governing your use of LocalKS.com (“LocalKS,” “we,” “us,” or “our”). 3. Eligibility

You must be at least 13 years old to use LocalKS.com. By using the Service, you affirm that you meet this requirement.

4. User Accounts

If you create an account, you agree to:

  • Provide accurate and current information
  • Maintain the confidentiality of login credentials
  • Be fully responsible for all activity under your account

We may suspend or terminate accounts at our sole discretion for any reason, including but not limited to policy violations, suspicious activity, or misuse.

5. User-Generated Content

LocalKS allows users to submit reviews, photos, business edits, and various forms of media. By submitting content, you agree to the following:

5.1 Rights Granted to LocalKS

You grant LocalKS an irrevocable, perpetual, worldwide, royalty-free, fully transferable, and sublicensable license to:

  • Use, reproduce, archive, modify, publish, display, distribute, and adapt your content
  • Create derivative works
  • Use content for SEO, marketing, advertising, directory enhancement, or any operational purpose

This license remains in effect even if you delete your account or content.

5.2 Public Display and Search Engine Indexing

Your submissions may appear publicly across LocalKS.com and may be indexed or cached by external search engines.

5.3 Content Standards

You may not submit content that is:

  • False, misleading, or defamatory
  • Unlawful or infringing upon any third-party rights
  • Harmful, abusive, explicit, or discriminatory
  • Automated, spam-based, or malicious in nature

We may remove or modify content at our discretion.

6. Prohibited Conduct

You agree not to:

  • Scrape, harvest, or download bulk data
  • Use bots, spiders, or automation without permission
  • Attempt to reverse-engineer or disrupt site functionality
  • Upload harmful code or engage in security breaches

Violations may result in account termination or legal action.

7. Business Listings & Accuracy Disclaimer

LocalKS aggregates business and location data from OpenStreetMap, user contributions, and public sources.

We do not guarantee the accuracy, reliability, completeness, or timeliness of any listing, map, address, or business detail.

Use of our directory information is at your own risk.

8. Intellectual Property

LocalKS retains all intellectual property rights in:

  • The directory structure and compiled business datasets
  • Website architecture, design, and organization
  • Proprietary enhancements, features, and tools

User-submitted content is licensed to us under Section 5.

9. Third-Party Services

LocalKS integrates with third-party providers including:

  • Google AdSense (advertising)
  • Google Analytics (analytics)
  • OpenStreetMap (mapping data)

Use of the Service constitutes acceptance of their respective policies.

10. Termination

We may suspend or terminate access to the Service—without notice—for:

  • Violations of these Terms

11. Disclaimers

To the fullest extent permitted by law:

  • We do not guarantee error-free operation, uninterrupted access, or accurate listings.

12. Limitation of Liability

  • LocalKS is not liable for direct, indirect, incidental, consequential, punitive, or special damages.
  • Your sole remedy for dissatisfaction with the Service is to discontinue use.
  • You waive any right to claim damages resulting from:
    • Inaccurate listings
    • Mapping errors
    • Data loss
    • User submissions
    • Service interruptions

13. Indemnification

You agree to indemnify, defend, and hold harmless LocalKS, its owners, employees, affiliates, and service providers from any claims, liabilities, losses, damages, costs, or expenses arising out of:

  • Your use of the Service
  • Your content submissions
  • Your violation of these Terms
  • Your violation of any applicable laws or third-party rights

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles.

You agree that any legal action must be brought exclusively in the state or federal courts located within Kansas.

15. Changes to Terms

We may update or modify these Terms at any time. Continued use of the Service constitutes acceptance of any modifications.
